Im really sorry to hear that, at least you can escape to Brians and not have drama directly affect you although indirectly im sure that it will. I would stop feeling sorry for your dad because it seems that he keeps setting himself up like a bowling pin only for your my to roll down the lane and knock him out again, once a cheater always a cheater. And no, my mother hasn't slept with this other man yet, if she commits adultry she would lose rights over my little sister in court, and she's counting on taking her with her, even though my little sister doesn't want to. And that's probably the only reason she hasn't slept with him yet.
I think that what your Mom has done thus far would be considered an "affair" with "intent" to persue adultury, and would look bad enough in court. Also, at Leah's age, wouldn't she have some say in where she lives?
Haha, nooo, I probably just watched one too many Divorce Court shows and the only law class I studied was Business Law in 12th grade, hahah. You'd be surprised that a lot of law stuff is just common sense with big words added.
If the child is 13 or older they will talk with the child to discuss living arrangements. The courts do favor the mother in most cases, however.
It's unlikely that adultery would be grounds for loss of custody. Usually drug uses, financial state, living conditions are factors for deciding custody.
I think that adultury has some grounds in the divorce, because my Dad's friend had an interesting case when he was trying to get custody of his kids. The wife turned out to be a lesbian and had a sexual affair and was in a relationship with another woman, and my Dad's friend said this was adultry, but the judge said that it wasn't under the grounds that there was no penetration....Isn't that fucked up?
